No by-polls till six weeks: HC tells EC

Hyderabad,  In a reprieve to expelled congress MLAs Komati Reddy Venkat Reddy and Sampath Kumar, High Court today directed the Election Commission to avoid giving any notification for by-elections for six weeks.
The High Court, which heard the arguments on both sides, has directed the State government and Legislature secretary to submit a report of CD with the details of the Assembly incident by March 22. The Court adjourned the case for next hearing to March 26. Advocate General Jayaprakash Reddy argued the case on behalf of the State government and informed that the Congress MLAs caused an insult to the Assembly by throwing headphone at the podium injuring Council Chairman Swamy Goud during joint address by Governor ESL Narasimhan.
The Advocate General said the government was ready to submit the details. The Court sought to know the Election Commission whether it has any objection if it stays the expulsion orders by the Assembly. Jayaprakash Reddy also said Supreme Court and High Courts used to inform that the Assembly has the powers and privileges to take such decisions when some untoward incidents take place.
The State Government appealed to the EC to conduct by-elections as the two seats are falling vacant after expulsion by the Speaker followed by the incident. It may be said here that the Assembly Speaker expelled the rebel Congress members for the affront in the Assembly on the first day of the budge session on March 12. A related notification of orders expelling Venkat Reddy and Sampath were issued by Legislature Secretary Narsimhacharyulu.
