HC declines to stay disqualification of Yadava Reddy, Ramul

Hyderabad, : The Hyderabad High Court today declined to stay the disqualification of MLCs Ramulu Naik and Yadav Reddy for defecting to the Congress from the TRS.

Leaders Bhupathi Reddy, Yadava Reddy and Ramulu Naik moved the court challenging the decision of then Council chairman Swamy Goud for disqualifying them for defecting to the Congress. Hearing the case, the court has observed that there was no need to stay the Chairman’s orders of disqualifying them for defecting to other party as per legislature procedures. The court rejected their petitions and declined to stay the disqualification orders given by then chairman Swamy Goud.

Since the chairman had taken a decision followed by legislature procedures and established norms, there was no need for staying those orders, the court said. However, the Congress leaders pleaded with the court not to hold the polls for the vacant posts until they move Supreme Court in this regard. On this, the court asked the Election Commission to look into the issue whether to hold polls or not. The Council chairman had already taken a decision to disqualify Bhupathi Reddy, Yadava Reddy and Ramulu Naik for defecting over to the Congress from the TRS.

The TRS party had appealed to the Council chairman to disqualify them as per legislature procedures and a decision was taken. A case on Bhpathi Reddy was still pending as he challenged a para in 10th schedule of the Constitution. The case was heard and the verdict was reserved by the court.
